Angelcare Holding Inc. and its affiliates, successors and assigns (collectively, “Angelcare”“we”“us”“our”), acting as data controllers, are committed to protecting your privacy and safeguarding your Personal Data. The purpose of this Privacy Policy (the “Policy”) is to provide you with information about our privacy practices, including how we collect, use, and disclose your Personal Data.
This Policy applies when you visit or use any of our websites, including www.angerlcaregroup.com, and any other website managed, operated and/or administered by or on behalf of Angelcare (our “Site”). This Policy also applies to any other product, service or application we offer, and which refers or links to this Policy, including:

  • Use of our products, services, and applications
  • Information shared or posted on our Sites, our blogs or our social media accounts
  • Any other case where you provide us with Personal Data

By submitting your Personal Data to us, by registering for or using any of the services we offer, by using our Site, or by voluntarily interacting with us, you consent to our collecting, using and disclosing your Personal Information as set out in this Policy, as revised from time to time.

What We Mean by “Personal Data”

Throughout this Policy, “Personal Data ” means any information about an individual that directly or indirectly allows that individual to be identified, such as name, phone number, postal and email address, payment details, online tracking identifiers such as IP addresses, or any other information that, when used in combination with other available information, allows a person to be identified, such as a person’s age, occupation, and place of work.

Personal Data does not include information that has been anonymized or aggregated in such a way that there is no serious possibility it can be used to identify an individual, whether on its own or in combination with other information.

 

Angelcare collects, uses and discloses Personal Data that you provide to us with your consent.

We collect, use and disclose your Personal Data with your consent, or as permitted or required by law. How we obtain your consent and its form (i.e., whether express or implied) depends on the circumstances and well as the sensitivity of the information collected. When information is considered sensitive in nature, express consent is typically required before it can be collected. Otherwise, for other types of information, consent is usually implied. If you choose to provide us with your Personal Data, we will assume that you consent to its collection, use and disclosure as set out in this Policy.

Your consent is valid only for the purposes for which it was requested.  Otherwise, if we want to use your Personal Data for a purpose other than the one identified at the time of collection, we will seek your consent prior to such new use.

You may withdraw your consent to our collection, use or disclosure of your Personal Data at any time by contacting us using the information in the “Contact Us” section below. Before we can process your request, we may require proof of your identity. In some cases, withdrawal of your consent may mean that we will no longer be able to provide certain products or services.

If you provide us with the Personal Data of another individual, you are responsible for obtaining the consent of that individual to enable us to collect, use and disclose their information.

 

Types of Personal Data We Collect

The information we may collect about you varies depending on the nature of our relationship with you and which of our products and services you use. 

Generally, the Personal Data we collect falls into the following categories, not all of which may apply to you:

 

  • Interactions through Angelcare products, services or our Site
    • Information you provide. We collect the information you submit to us through your use of our products, services and our Site, for example when you purchase products, register products, create an account, sign up to receive our emails, enter contests, post on our Site, or make other submissions. Such information includes any information you provide to us, such as your name, email address, telephone number, mailing address, shipping address, the subject of your request, and any other information you provide us.
    • Job applications. When you apply for a job through our Site or by sending us an email, we collect the information you provide such as your name, your CV and your cover letter.
    • Information we collect automatically. Like most websites and other internet services, we may collect certain information about your use of our Site automatically, such as log data, your IP address, device type, browser type, your broad geographic location (i.e., country or city-level location), the date and time of your visit, information about how your device has interacted with our Site, including the pages you accessed and the links you clicked, and other technical information.
    • Tracking Technologies, Analytics and Cookies. We and our service providers use technologies such as cookies, beacons, tags and scripts to analyze trends, administer the Site, track users’ movements around the Site and otherwise on the Internet, and gather demographic information about our user base. We may receive reports based on the use of these technologies on an individual as well as aggregated basis. The technologies we use are outlined below:
      • Cookies. We use cookies for record-keeping purposes, to determine Site traffic, convey useful information about your interests, and to personalize any future visits you make to the Site. We may also employ third-party service providers to place advertisements about our products, services and applications on other websites. The use of cookies or other similar technologies by such third parties is governed by their privacy policies. Please be aware that if you reject cookies, you may still use our Site, but your ability to use some features or areas of our Site may be limited.
      • Analytics / Log Files. We gather certain information automatically and store it in log files. This information includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users’ movements around the Site and to gather demographic information about our user base as a whole. We do not link this automatically collected data to Personal Data.
      • LSOs. We use Local Storage Objects (LSOs) such as HTML 5 to store content information and preferences. Third parties who provide certain features on our Site or display advertising based upon your web browsing activity use LSOs such as HTML 5 to collect and store information. Various browsers may offer their own management tools for removing HTML 5 LSOs.
      • Behavioral Targeting / Retargeting. We retain the services of a third party to either display advertising on our Site or to manage our advertising on other platforms. Our third-party service provider uses cookies and web beacons to collect information about your activities on this Site and other websites to provide you targeted advertising based upon your interests. If you wish to receive such advertisements, you can opt-in to having the required information collected from you by adjusting your cookie settings on our Site. Otherwise, only cookies considered essential for the proper functioning of the Site are set to “opt-out” by default. We will ask you for your consent for all other non-essential cookies.
    • Social Media Widgets. Our Site includes social media features, such as the Facebook Like, Twitter, Pinterest, Instagram, Google+, LinkedIn and YouTube button and widgets, such as the “Share this” button or interactive plug-ins that run on our Site. These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy notice of the host.
    • Single Sign-On. When you leave a product review on our site, you may opt to use the “Facebook Connect” or “Google Connect” feature. This service will authenticate your identity and provide you the option to share certain Personal Data with us such as your name and email address to pre-populate the review form. Services like Facebook Connect and Google Connect give you the option to post information about your activities on this Site to your profile page to share with others within your network.
    • Other interactions. For individuals who interact with us other than through our Site, products and services, whether in person, by phone or email, through social media or otherwise, we may collect information you provide through these other interactions. This information may include your name, e-mail address and other contact information.

Please note that we do not collect payment card information. If you make an online payment using a payment card, such as a credit card or debit card, you are connected directly to our online payment processing service provider and your payment card information is collected and processed by that service provider.

 

Our Practices Regarding Children’s Privacy

We encourage parents and guardians to supervise their children’s use of the Internet, including our Site.

We do not knowingly collect Personal Data from individuals under the threshold age for consent under privacy laws applicable in their jurisdiction. Children under the age the threshold age should not use this Site or provide us with any Personal Data without the consent and supervision of their authorized guardian.

If you are a parent or guardian and you are aware that your Children has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from Children without verification of parental consent, we take steps to remove that information from our servers.

 

How We Use Your Personal Data

We use your Personal Data to provide and improve our services to you. We also use it to meet our legal obligations. 

We may use your Personal Data and other information you provide to us for the purposes outlined below, for other purposes for which we have obtained your consent, or as may be permitted or required by applicable law.

For residents of European Economic Area (“EEA ”) Members states, the applicable legal basis under the European Union’s General Data Protection Regulation (“GDPR ”) is provided in brackets for each of the purposes listed below.

  • To send you requested product or service information or to respond to and process your other requests, questions and concerns, such as for support or customer service or to process your job application [ performance of a contract]

How We Share Your Personal Data

We may share your Personal Data within the Angelcare Group so that we can notify you about products, services, rewards and special offers you might enjoy. We may also share your Personal Data with third parties for the purposes described in this Policy, to meet a legal obligation, or to enforce our rights. We do not sell your Personal Data to third parties.

 

  • Service Providers

We may use service providers to perform services on our behalf. For example, we may hire an individual or organization to perform work on our behalf. We only provide these service providers with the Personal Data necessary to perform the services.

We prohibit them from using Personal Data for any purpose other than to perform the services for which they have been retained. These service providers are not permitted to share this Personal Data with others. When we disclose Personal Data to third parties, we protect such data by entering into contractual agreements and, to the extent applicable, written undertakings with them, requiring them to adopt reasonable privacy and security procedures and measures and to otherwise comply with all applicable privacy laws.

 

  • As Permitted or Required by Law

We may also disclose your information when we believe such disclosure is permitted, necessary or appropriate:

    • To respond to requests from public and government authorities, including public and government authorities outside your country of residence
    • To enforce the terms of the agreements for our products and services
    • To protect our operations or those of any of our affiliates or subsidiaries
    • To protect our rights, privacy, safety or property, and/or those of our affiliates, you or others
    • To allow us to pursue available remedies or limit the damages that we may sustain.  In addition, we may transfer your Personal Information and other information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, brands, affiliates, subsidiaries or other assets
    • In the context of a business transaction such as a reorganization, merger, sale, joint venture, assignment or other disposition of all or part of our business, brands, affiliates, subsidiaries or other assets. In such cases, you will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of your Personal Data, as well as any choices you may have regarding your Personal Data.
    • To enter into an agreement or for any other recognized purpose that we may have for disclosing information

Except when legally permitted, if we otherwise intend to disclose your Personal Data to a third party, we will identify that third party and the purpose for the disclosure and obtain your consent before disclosing the information.

 

How to Opt Out of Marketing Communications

We will only send you marketing communications if you give us your express consent to do so, or if another reason allows us to do so by law, such as if you purchased a product or service from us or enquired about our products and services.

You can always request to stop receiving marketing communications from us. You can do so by clicking the “unsubscribe” link in each marketing email, by editing your account settings on the Site, or by emailing our Privacy Officer at privacy@angelcaregroup.com or by contacting us using the details provided in the Contact Us section below.

Please note that if you opt-out from receiving marketing-related emails, we may still need to send you communications about your use of our products or services, or other matters.

 

How Long We Retain Personal Data

We will use, disclose or retain your Personal Information only for as long as necessary to fulfill the purposes for which that Personal Information was collected or as permitted or required by law.

 

Where We Store Personal Data, and Information about International Transfers

We currently process and store Personal Data in North America, Europe and the UK where ANGELCARE has establishments, and in other countries where we use third party service providers. It is therefore possible that we transfer Personal Data to countries other than your country/province/state of residence, where privacy rules may be different.

If your Personal Data is processed outside of your country/province/state of residence, it is subject to the laws of the country/province/state in which it is located and may be disclosed to the governments, courts, law enforcement agencies or regulatory bodies of that other country or disclosed in accordance with the laws of such country. However, our practices regarding your Personal Data will at all times be governed by this Policy and applicable privacy laws and, if applicable, we will comply with the GDPR requirements providing adequate protection for the transfer of Personal Data from the EU/EEA to third country, such as standard contractual clauses.

 

How We Protect Your Personal Data

We have implemented physical, organizational, contractual and technological security measures in order to protect your Personal Data from loss, theft, unauthorized access, disclosure, copying, use or modification. For example, we have taken steps to ensure that access to Personal Data within Angelcare is granted only to those with a business ‘need-to-know’ or whose duties reasonably require such information. We also follow generally accepted standards and implement appropriate levels of security to protect the Personal Data submitted to us, both during transmission and once we receive it. Lastly, all third parties that obtain Personal Data from us are contractually required to protect that information in a manner consistent with this Policy and/or as required by applicable law.

Despite the measure outlined above, no method of transmission or storage is 100% secure or error-free, so we cannot guarantee absolute security. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any information that you provided to us has been compromised), please contact us immediately using the contact information in the “Contact Us” section below.

 

Your Rights Regarding Your Personal Data

Your rights regarding your Personal Data may vary depending on where you live. 

Accuracy. We assume that the information you provide us with is accurate and up-to-date and we will not routinely update your Personal Data unless such a process is necessary. Therefore, if any of your Personal Data changes over the course of your business relationship with us, we expect you to notify us of such changes so that your customer record can be updated.

Access and Rectification . Upon written request and subject to proof of identity, you can request access to and a copy of the Personal Data we collected about you. You can also ask that we correct, update, or limit the processing of your Personal Data where applicable and as authorized or required by law. We will process such requests to the extent that they are reasonable.

Right to Withdraw Consent . In some circumstances and subject to proof of identity and any applicable legal or contractual restrictions, you may have the right to withdraw your consent to the further use or disclosure of the Personal Data we collected about you. In some cases, withdrawal of your consent may mean that we will no longer be able to maintain our business relationship with you.

Requesting Other Information. You may also have the right to request information about:

  • The ways in which your Personal Data was collected from you and how it has been used
  • The names of the individuals and organizations who have access to your Personal Data within Angelcare and details about how long we store it
  • The use of any automated decision-making systems and the impact they may have on you

Right to Lodge a Complaint. You also always have the right to lodge a complaint with the relevant data protection authority in the jurisdiction where you reside.

Additional Rights for Individuals in the EU/EEA. If you are a resident of a country of the EU/EEA, under the GDPR, you may be entitled to additional rights, including:

  • The right to erasure of Personal Data about you, under certain conditions
  • The right to demand that we restrict processing of your Personal Data, under certain conditions, if you believe we have exceeded the legitimate basis for processing, if processing is no longer necessary, or if you believe your Personal Data is inaccurate
  • The right to portability of your Personal Data, under certain conditions
  • The right to object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you, under certain conditions

Once your request has been received, and subject to proof of your identity, we will provide you with a written response within 30 days from the date of receipt of your request, unless we are legally entitled to extend this period, in which case we would notify of such extension within the 30-day period. In some specific cases and in compliance with applicable privacy laws, we may refuse to provide you with the Personal Data requested or we may redact (black out) certain information from the records that we provide you with.

Your failure to provide certain Personal Data to Angelcare may justify Angelcare’s refusal to process any order for the purchase of products or services sold through the Site or to make available certain features of the Site.
